Probate: Guardianship Proceedings and Motion to Terminate Parental Rights
Proceedings below: After having guardianship for several years, Appellants filed a Motion to Terminate the mother’s parental rights. After hearing the evidence at an adjudication hearing, the trial court dismissed the matter finding that the Appellants lacked standing to bring a Motion to Terminate Parental Rights. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignment of error: 1) The Lower Court erred in denying it had subject matter jurisdiction to hear the action for termination of parental rights as filed by the Guardians of the minor child.
