Proceedings below: The county court found clear and convincing evidence that Patrick W. was incapacitated and that no least restrictive alternative to guardianship existed.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues: Appellant makes the following assignments of error:  1) The County Court erred as a matter of law by accepting Exhibit 3 into evidence under NEB. REV. STAT.§ 30-4204; 2) The County Court erred in allowing Exhibit 3 into evidence when no evidence was on the record the GAL had obtained Exhibit 3; 3) The County Court erred by accepting Exhibit 3 into evidence as it contained inadmissible hearsay; 3) The County Court erred when it found clear and convincing evidence on the record that Mr. Whitehead was incapacitated; and 4) The County Court erred when it found clear and convincing evidence a full guardianship was the least restrictive means to provide continuing care for Mr. Whitehead.
