Criminal: Proximately Causing Serious Bodily Injury while Driving Under the Influence (DUI), Motion to Suppress, and Excessive Sentence

Proceedings Below:  The trial court overruled Appellant’s Motion to Suppress the results of a DUI chemical test, and Appellant was convicted of Proximately Causing Serious Bodily Injury while DUI.  Appellant was sentenced to eighteen (18) months in prison and eighteen (18) months post release supervision.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues: Appellant raises the following assignments of error:  1) District Court committed reversible error by overruling Appellant’s Motion to Suppress the results of the DataMaster test; and 2) The sentence imposed by the District Court is excessive and constitutes an abuse of discretion.
