Proceedings below:  The district court denied Appellant’s Motion for Postconviction Relief without an evidentiary hearing.  The Appellee filed a Petition to Bypass the Court of Appeals, which the Supreme Court granted and ordered that this case be transferred from the docket of the Court of Appeals to its docket. 

Issues:  Appellant makes the following assignments of error:  1) The trial court erred when it failed to clearly state that the appellant’s Nebraska sentence was to be served concurrent to his Massachusetts sentence; 2) Appellant’s counsel was ineffective for failing to file and perfect a direct appeal when the appellant directed him to do at the conclusion of the sentencing hearing; 3) The district court erred when it failed to provide appellant with an evidentiary hearing on the appellant’s claim of ineffective assistance of counsel; 4) The district court erred in finding that the appellant’s Motion for Postconviction Relief was procedurally barred; and 5) the district court erred in finding that the appellant’s Motion for Postconviction Relief was time barred.
