Appeal from District Court for Lancaster County, Judge Robert R. Otte, on appeal from the County Court for Lancaster County, Judge Timothy C. Phillips.

Criminal:  First Offense DUI, Open Container, and Careless Driving

Proceedings below:  Appellant was convicted of First Offense DUI, Open Container, and Careless Driving and sentenced to seven (7) days in jail, fined $610 plus court costs, and his driver’s license was suspended for six (6) months.  On appeal to the district court, his conviction was affirmed.   On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.       

Issues:  Appellant makes the following assignment of error:  The evidence was insufficient to support a conviction of driving under the influence, possessing an open alcohol container, and careless driving.
