S-23-0329 Michael Zeiler (Appellee) v. Kenneth Reifschneider (Appellant)
Appeal from District Court for Scotts Bluff County, Judge Leo P. Dobrovolny
Attorneys: Adam A. Hoesing (Simmons Olsen Law Firm, P.C., L.L.O. for Appellant) and Tylor Petitt (Shapiro Riha Law LLP for Appellee)
Civil: Standing and Contempt
Proceedings below: The trial court found that Appellee had standing to sue and found Appellant in willful contempt of court regarding a prior consent judgment. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following statement of errors: 1) The District Court erred by finding Zeiler had standing to sue; 2) The District Court erred by finding Reifschneider to be in willful contempt of the Consent Judgment by clear and convincing evidence; and 3) The District Court erred by failing to interpret the Consent Judgment within the “four corners” of the document.
